The following are a few important issues regarding the taxation regarding residency:<\/p>\n<ul>\n<li>Income tax obligations in Canada based on residency<\/li>\n<li>Determining residency on a case-by-case basis and all the facts that must be considered<\/li>\n<li>Steps you can take to help make that determination<\/li>\n<\/ul>\n<h2>Step 1: Determine Residential Ties<\/h2>\n<p>When determining residential ties, some items are more important than others. Family members living in Canada and a home that you can come back to give you strong personal ties to Canada, so these are the first items that the CRA looks to determine if an individual is a resident. Other items will help to flesh out the full picture of whether someone is a resident, which will be used to make a determination in difficult circumstances. The following are some examples of ties used to determine residency:<\/p>\n<ul>\n<li>Significant Residential Ties: Home, Spouse, Dependents<\/li>\n<li>Secondary Residential Ties: Drivers License, Passport, Memberships, Car, Furniture, Bank Accounts, Credit Cards, Health Card\/Insurance<\/li>\n<\/ul>\n<p>For more information regarding determining residency, the CRA provides more information at the following address:<\/p>\n<ul>\n<li><a href=\"https:\/\/www.canada.ca\/en\/revenue-agency\/services\/tax\/technical-information\/income-tax\/income-tax-folios-index\/series-5-international-residency\/folio-1-residency\/income-tax-folio-s5-f1-c1-determining-individual-s-residence-status.html\">Income Tax Folio S5-F1-C1, Determining an Individual\u2019s Residence Status<\/a><\/li>\n<\/ul>\n<h2>Step 2-A: Determine Status &amp; Tax Implications<\/h2>\n<h3><strong><u>Leaving Canada<\/u><\/strong><u><br \/><\/u><\/h3>\n<h4><strong>1.) Factual Resident<\/strong><\/h4>\n<ul>\n<li>If an individual is temporarily employed, vacationing, or attending school <em>outside of Canada <\/em>but maintains residential ties within Canada you may still be considered a <a href=\"_wp_link_placeholder\" data-wplink-edit=\"true\">factual resident<\/a>.<\/li>\n<li>The Term factual resident means even though you left Canada, you are still considered a resident of Canada for Tax Purposes.<\/li>\n<\/ul>\n<h4><strong>2.) Emigrant<\/strong><\/h4>\n<ul>\n<li>If you exited Canada and live in a new country with a permanent home while <em>severing ties with Canada<\/em>, <u>ceasing to be a resident of Canada<\/u> in the Tax Year you may be considered to be an <a href=\"https:\/\/www.canada.ca\/en\/revenue-agency\/services\/tax\/international-non-residents\/individuals-leaving-entering-canada-non-residents\/leaving-canada-emigrants.html\">emigrant<\/a>.<\/li>\n<li><u>Emigrant for income tax purposes if:<\/u>\n<ul>\n<li>You Leave Canada to Live in Another Country<\/li>\n<li>You Sever Your Residential Ties with Canada<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p><em><span style=\"color: #ff0000;\">** If you leave Canada and maintain residential ties, usually considered factual resident.<\/span><\/em><\/p>\n<h4><strong>3.) Deemed Non-Resident<\/strong><\/h4>\n<ul>\n<li>If you build ties with a Country that Canada has a <em><u>Tax Treaty <\/u><\/em>with and you\u2019re a resident of that Country, but you maintain significant residential ties with Canada (factual resident of Canada) you may be considered a <em><u>deemed non-resident <\/u><\/em>of Canada.<\/li>\n<\/ul>\n<p><span style=\"color: #ff0000;\">** <em>Deemed non-residents <\/em>are equal to non-residents<\/span><\/p>\n<h4><strong>4.) Special Cases<\/strong><\/h4>\n<ul>\n<li>If you left Canada and you are a member of the Canadian Armed forces or a government employee, you are usually considered a factual resident or a deemed resident of Canada. Refer to Government <a href=\"https:\/\/www.canada.ca\/en\/revenue-agency\/services\/tax\/international-non-residents\/individuals-leaving-entering-canada-non-residents\/government-employees-outside-canada.html\">employees outside Canada<\/a> for more information.<\/li>\n<\/ul>\n<h3><span style=\"text-decoration: underline;\"><strong>Entering Canada<\/strong><\/span><\/h3>\n<h4><strong>1.) Immigrant<\/strong><\/h4>\n<ul>\n<li>If you left another country and established significant residential ties with Canada during the taxation year, you may be considered an <a href=\"https:\/\/www.canada.ca\/en\/revenue-agency\/services\/tax\/international-non-residents\/individuals-leaving-entering-canada-non-residents\/newcomers-canada-immigrants.html\">immigrant<\/a><\/li>\n<li>Immigrant for tax purposes only applies for the first taxation year and thereafter a taxpayer would not be considered a newcomer to Canada.<\/li>\n<\/ul>\n<h4><strong>2.) Deemed Non-Resident<\/strong><\/h4>\n<ul>\n<li>If you have ties with a country that Canada has a tax treaty with, and considered a resident of that country but also considered a factual resident of Canada (<em>due to establishing significant ties with Canada during the year), <\/em>you may be deemed a non-resident of Canada for tax purposes.<\/li>\n<\/ul>\n<h4><strong>3.) Deemed Resident<\/strong><\/h4>\n<ul>\n<li>If you do not have significant ties with Canada to be considered a factual resident, you may be <a href=\"https:\/\/www.canada.ca\/en\/revenue-agency\/services\/tax\/international-non-residents\/individuals-leaving-entering-canada-non-residents\/deemed-residents.html\">deemed a resident<\/a> <a href=\"https:\/\/www.canada.ca\/en\/revenue-agency\/services\/tax\/international-non-residents\/individuals-leaving-entering-canada-non-residents\/deemed-residents.html\">of Canada<\/a> if you spend 183 days or more in Canada.<\/li>\n<\/ul>\n<h2>Canada Revenue Agency\u2019s Opinion<\/h2>\n<ul>\n<li>If there is much grey area and more light needs to be shed on the situation, CRA can assist in determining a tax payer\u2019s residency status.<\/li>\n<li>File <a href=\"https:\/\/www.canada.ca\/en\/revenue-agency\/services\/forms-publications\/forms\/nr74-determination-residency-status-entering-canada.html\">Form NR-74 <\/a>(Entering Canada)<\/li>\n<li>File <a href=\"https:\/\/www.canada.ca\/en\/revenue-agency\/services\/forms-publications\/forms\/nr73-determination-residency-status-leaving-canada.html\">Form NR-73 <\/a>(Leaving Canada)<\/li>\n<\/ul>\n<h2>Tax Obligations<\/h2>\n<p><strong><u>As a\u00a0factual resident\u00a0you:<\/u><\/strong><\/p>\n<ul>\n<li>Must report your world income (income from all sources, both inside and outside Canada) for the entire tax year;<\/li>\n<li>Can claim all deductions, federal, provincial, or territorial non-refundable and refundable tax credits, that apply to you;<\/li>\n<li>Must pay federal tax;<\/li>\n<li>Must pay <a href=\"https:\/\/accountingtoronto.ca\/staging\/provincial-sales-tax-pst-for-business-and-self-employed-individuals-101\/\">provincial or territorial tax<\/a> for the province or territory where you keep residential ties; and<\/li>\n<li>May be eligible for the <a href=\"https:\/\/accountingtoronto.ca\/staging\/gst-hst-for-business-and-self-employed-individuals-101\/\">GST\/HST<\/a> credit\u00a0(goods and services tax\/harmonized sales tax), the <a href=\"https:\/\/www.canada.ca\/en\/revenue-agency\/services\/child-family-benefits\/canada-child-benefit-overview.html\">Canada child benefit<\/a>.<\/li>\n<\/ul>\n<p>For more information, see the\u00a0<a href=\"https:\/\/www.canada.ca\/en\/revenue-agency\/services\/forms-publications\/publications\/5000-general-income-tax-benefit-guide-2016-provinces-except-non-residents.html\">General Income Tax and Benefit Guide<\/a>.<\/p>\n<p><strong><u><br \/>As a\u00a0deemed resident\u00a0you:<\/u><\/strong><\/p>\n<ul>\n<li>Must report your world income (income from all sources, both inside and outside Canada) for the entire tax year;<\/li>\n<li>Can claim all deductions and non-refundable tax credits that apply to you;<\/li>\n<li>Are subject to federal tax and instead of paying provincial or territorial tax you&#8217;ll pay a federal surtax;<\/li>\n<li>Can claim all federal tax credits, but you cannot claim provincial or territorial tax credits; and<\/li>\n<li>Are eligible for the goods and services tax\/harmonized sales tax (GST\/HST) credit.<\/li>\n<\/ul>\n\n\n<hr class=\"wp-block-separator has-css-opacity\"\/>\n\n\n\n<p><em>This site provides general information on various tax issues and other matters.
